Abstract

The subject of this study is comprised of “Prepaid residential property sales contract”.

The acquisition of residential property by human beings for the purpose of possessing a shelter has a significance in today’s world as it always has been. Some contracts that are called “mock-up sales”, “project sales”, “sell-and-build” and “show flat” among the public are concluded. Payments are made by consumers to sellers and suppliers for residential properties that do not exist in reality. In spite of these payments which are usually made in cash, or by instalments, consumers have been victimized as they cannot acquire their residential properties.

In this thesis, definition, elements, subject matter, form, content of prepaid residential property sales contract, and its differences with the contracts having similar legal features are explained as well as rights and obligations of both sellers and consumers.
