Covid-19, Çin üzerinden tüm dünyaya yayılan bir virüs türü olarak şimdiden dünya tarihine adını yazdırdı. Bugüne kadar dünya üzerinde pek çok salgın hastalık meydana gelmiştir. Ancak tüm dünyada insanların sokağa çıkmasına bu denli engel olması nedeniyle Covid-19’un etkisinin çok farklı boyutlarda olduğunu söyleyebiliriz. Tabi ki bu etkinin yaşanmasında teknoloji çağının hayatımıza kattıklarının büyük önemi var. Çünkü teknoloji ve bilim alanında bu kadar ileriye gitmiş insanoğlunun bir virüs karşısında böylesine çaresiz kalmasını kabullenmek hepimize zor geldi.
Tüm Dünya’da yaşanan salgın nedeniyle ülkelerde sokağa çıkma yasakları ilan edilerek bu virüsün yayılması engellenmeye çalışıldı. Özellikle İtalya ve İspanya’da çok hızlı şekilde yayılan Covid-19 kısa zamanda tüm Dünya’yı etkisi altına aldığı için sokağa çıkma yasağı ilan ederek virüsün bulaştığı insanların dolaşmasına engel olarak diğer insanların bu durumdan etkilenmesinin önüne geçilmeye çalışıldı. Tüm ülkelerde alınan tedbirlere benzer tedbirler ülkemizde de alınarak virüsün yayılması engellenmeye çalışılıyor. İlk olarak 10 Nisan 2020 tarihinde ilan edilen hafta sonu 48 saat sokağa çıkma yasağı uygulaması Ramazan Bayramı’nda da devam etti ve İç İşleri Bakanlığı tarafından yayımlanan Genelge ile 22.05.2020-26.05.2020 tarihleri arasında sokağa çıkma yasağı ilan edildi. Yine aynı Genelgenin son kısmında:
“Alınan kararlara uymayan vatandaşlara Umumi Hıfzıssıhha Kanununun 282’nci maddesi gereğince idari para cezası verilmesi başta olmak üzere aykırılığın durumuna göre Kanunun ilgili maddeleri gereğince işlem uygulanacak. Konusu suç teşkil eden davranışlara ilişkin Türk Ceza Kanunu’nun 195 inci maddesi kapsamında gerekli adli işlemlerin başlatılacak.” düzenlemesi yer almıştır. Burada yayımlanan Genelgeye uymayan vatandaşlar hakkında uygulanacak yaptırımlar belirtilmiştir.
İç İşleri Bakanlığı tarafından yayımlanan genelgelerde yer verilen Bulaşıcı hastalıklara ilişkin tedbirlere aykırı davranma suçu 5237 Sayılı Türk Ceza Kanunu’nun İkinci Kitap Üçüncü Kısım Üçüncü Bölümde düzenlenmiştir. Ceza Kanunumuzda yer verilen bu ayrıma baktığımızda ilgili suçun “Topluma Karşı Suçlar” başlığının “Kamunun sağlığına karşı suçlar” alt başlığında düzenlendiğini görmekteyiz.
İlgili madde:
“BULAŞICI HASTALIKLARA İLİŞKİN TEDBİRLERE AYKIRI DAVRANMA
Madde 195 – (1) Bulaşıcı hastalıklardan birine yakalanmış veya bu hastalıklardan ölmüş kimsenin bulunduğu yerin karantina altına alınmasına dair yetkili makamlarca alınan tedbirlere uymayan kişi, iki aydan bir yıla kadar hapis cezası ile cezalandırılır.” şeklindedir. Yukarıda yer verdiğimiz hüküm gereğince alınan tedbirlere aykırı davranan kişiler hakkında iki aydan bir yıla kadar hapis cezası verilebilecektir.
Madde metninde ‘bulaşıcı hastalıklardan birine’ cümlesi geçmektedir. Dolayısı ile bu madde metninden dolayı bir kişiye ceza verilebilmesi için ortada bir bulaşıcı hastalığın varlığından söz etmek gerekmektedir. Covid-19 tüm dünyada bulaşıcı olarak kabul edilen bir virüs türü olduğu için şu anda Covid-19 sebebiyle alınan sokağa çıkma yasağı kararlarının bulaşıcı hastalık kapsamında alındığı açıktır. Ayrıca yine madde hükmünde açıkça ‘bulaşıcı hastalıklardan birine yakalanmış veya bu hastalıklardan ölmüş kimsenin bulunduğu yer’den bahsetmektedir. Bu kapsamda örneğin yaşadığı çevrede Covid-19 virüsüne yakalananveya virüs sebebiyle ölen kimse bulunmayan birisi sokağa çıkma yasağı tedbirine uymadığı zaman hakkında bu madde hükmünce ceza verilebilecek midir?
Bu sorunun cevabı aslında kanunun lafzında yer alıyor gibi görünse de burada lafzi yorumla birlikte amaçsal yorum yönteminden de faydalanmak gerekmektedir. Böylece kanun metnine dair yapacağımız yorumda hem kanun maddesinde yer verilen bulaşıcı hastalıklardan birisine yakalanmış veya bu hastalık dolayısıyla ölmüş birinin bulunduğu yerin karantina altına alınmasına ilişkin alınan tedbirlere uymama halini dikkate alacak hem de amaçsal yorum kapsamında bu kanun maddesinin amacının salgın hastalıkların yayılmasının önüne geçmek olduğu gerçeğini göz ardı etmeyeceğiz.
Sonuç olarak Covid-19 salgını kapsamında alınan sokağa çıkma yasağına uymayan vatandaşlar hakkında Türk Ceza Kanunu’nun 195. maddesinin uygulanacak ve bu suçtan haklarında soruşturma açılanlar 2 aydan 1 yıla kadar hapis istemiyle yargılanabileceklerdir.

COVİD-19 Nedeniyle Getirilen Yasaklar Dolayısıyla Kesilen İdari Para Cezalarına İtiraz
Tüm Dünya’yı etkisi altına alan Covid-19 salgını sürecinde ülkemizde de birtakım tedbirler alınarak virüsün yayılması önlenmeye çalışıldı. Bu çerçevede ülkemizde alınan en önemli tedbir sokağa çıkma yasağı oldu. Sokağa çıkma yasağının hukukiliği ve Anayasa’ya uygunluğu başka bir yazının konusu olabilir. Ancak bu yazıda sokağa çıkma yasağı döneminde bu yasağa uymadığından bahisle ceza kesilen vatandaşlarımızın bu cezaya nasıl itiraz edebileceklerini anlatacağız.
Covid-19 sebebiyle belki de pek çoğumuzun ilk kez duyduğu 1593 Sayılı Umumi Hıfzıssıhha Kanunu uygulanma olanağı buldu ve bu kanuna dayanılarak idari para cezaları kesildi. Türk Dil Kurumu Güncel Türkçe Sözlüğü ’ne göre Arapça hıfz ve sıhha kelimelerinin birleşmesinden meydana gelen hıfzıssıhha kelimesi; ‘Sağlıklı yaşamak için alınması gerekli önlemlerin bütünü’ anlamına gelmektedir. [1] Bu kavram 06.05.1930 tarihinde Resmi Gazetede yayımlanarak yürürlüğe giren Kanunda da anlamına uygun olarak yer almıştır. Bahsettiğimiz 1593 sayılı Kanun, eski tarihli olduğu için kanun metninde yer alan kelimelerin dili biraz daha ağırdır. Ancak eski tarihli olsa da halen yürürlükte olan bu Kanun, Covid-19 nedeniyle yaşadığımız karantina dönemlerinde adını sıkça duyduğumuz bir kanun haline geldi.
Yaşadığımız bu zorlu süreçte sokağa çıkma yasakları İçişleri Bakanlığı tarafından yayımlanan genelgeler ile yürütüldü. Bakanlık tarafından yayınlanan genelgelere uygun olarak İl Umumi Hıfzıssıhha Kurulları tarafından da 1593 Sayılı Umumi Hıfzıssıhha Kanunu’nun ilgili maddelerine uygun olarak toplantılar yapıldı ve kararlar alındı.
Alınan kararlarda genellikle;
“İl Umumi Hıfzıssıhha Kurulu’nun aldığı kararlara uyulmaması halinde ve her seferinde ayrı ayrı olmak üzere;
- Umumi Hıfzıssıhha Kanunu’nun 282. maddesi gereğince 3.150,00 TL,
- Kabahatler Kanunu’nun 32. maddesi gereğince 392,00 TL, idari para cezası uygulanmasına,
- Türk Ceza Kanunu’nun Bulaşıcı Hastalıklara İlişkin Tedbirlere Aykırı Davranma başlıklı 195. maddesinde yer alan “… yetkili makamlarca alınan tedbirlere uymayan kişi, iki aydan bir yıla kadar hapis cezasıyla cezalandırılır.” hükmü uyarınca, bu hükme uymayan kişilerin, haklarında gerekli adli işlemler takdir ve ifa edilmek üzere adli makamlara bildirilmesine,
- İşyerleri ve firmalar hakkında ilgili mevzuat uyarınca gerekli yaptırımların uygulanmasına,
İl Umumi Hıfzıssıhha Kurulumuzca, 5442 sayılı İl İdaresi Kanunu’nun 11/C maddesi ve
1593 sayılı Umumi Hıfzıssıhha Kanunu’nun 27. ve 72. maddeleri uyarınca, 21.04.2020 tarihinde oybirliği ile karar verilmiştir.” ifadeleri yer almaktadır. [2]

1593 Sayılı Umumi Hıfzıssıhha Kanunu’nun “Ceza Hükümleri” başlıklı 14. Bap 282. maddesinde;
“Bu Kanunda yazılı olan yasaklara aykırı hareket edenler veya zorunluluklara uymayanlara, fiilleri ayrıca suç oluşturmadığı takdirde,789 Türk Lirasından 3.180 Türk Lirasına kadar idari para cezası verilir.” hükmü, [3]
Ayrıca 5326 Sayılı Kabahatler Kanunu’nun “Emre aykırı davranış” başlıklı 32. maddesinde;
“Yetkili makamlar tarafından adlî işlemler nedeniyle ya da kamu güvenliği, kamu düzeni veya genel sağlığın korunması amacıyla, hukuka uygun olarak verilen emre aykırı hareket eden kişiye yüz Türk Lirası (Güncel Tutar: 392 TL) idarî para cezası verilir. Bu cezaya emri veren makam tarafından karar verilir.” hükmü yer almaktadır.
Covid-19 sebebiyle sokağa çıkma yasağı ilan edilen illerimizde bu yasağa uymayan vatandaşlarımıza yukarıda yer verdiğimiz kanun hükümlerine uygun olarak idari para cezaları kesilmiştir.
İtiraz Yöntemi
5326 Sayılı Kabahatler Kanunu’nun “Kararların tebliği” başlıklı 26. maddesinde;
“İdarî yaptırım kararı, 11.2.1959 tarihli ve 7201 sayılı Tebligat Kanunu hükümlerine göre ilgili kişiye tebliğ edilir. Tebligat metninde bu karara karşı başvurulabilecek kanun yolu, mercii ve süresi açık bir şekilde belirtilir.” hükmü,
Aynı Kanunun “Başvuru yolu” başlıklı 27. maddesinde;
“(1) İdarî para cezası ve mülkiyetin kamuya geçirilmesine ilişkin idarî yaptırım kararına karşı, kararın tebliği veya tefhimi tarihinden itibaren en geç onbeş gün içinde, sulh ceza mahkemesine başvurulabilir. Bu süre içinde başvurunun yapılmamış olması halinde idarî yaptırım kararı kesinleşir.
(2) Mücbir sebebin varlığı dolayısıyla bu sürenin geçirilmiş olması halinde bu sebebin ortadan kalktığı tarihten itibaren en geç yedi gün içinde karara karşı başvuruda bulunulabilir. Bu başvuru, kararın kesinleşmesini engellemez; ancak, mahkeme yerine getirmeyi durdurabilir.
(3) Başvuru, bizzat kanunî temsilci veya avukat tarafından sulh ceza mahkemesine verilecek bir dilekçe ile yapılır. Başvuru dilekçesi, iki nüsha olarak verilir.
(4) Başvuru dilekçesinde, idarî yaptırım kararına ilişkin bilgiler, bu karara karşı ileri sürülen deliller açık bir şekilde gösterilir.” hükmü,
Anılan kanun hükümleri kapsamında sokağa çıkma yasağına uymadığı için kendisine 3.150 TL tutarında idari para cezası kesilen ve bu ceza kendisine tebliğ edilen vatandaşlarımız, ceza tutanağının tebliğ edildiği tarihten itibaren 15 gün içinde ikamet ettikleri yerdeki Sulh Ceza Mahkemesine başvurarak bu kararlara itiraz edebileceklerdir. Burada dikkat edilmesi gereken önemli noktalardan birisi kanun metninde geçen ‘tefhim’ kelimesidir. Tefhim, anlatma bildirme anlamına gelen bir kelimedir. Dolayısıyla yüzünüze karşı kesilen ve tutanağın o anda imzalatıldığı durumlarda artık idari para cezası tutanağının tebliğinin beklenilmesine gerek yoktur. İdari para cezası tutanağının tutulduğu ve bu husus ilgili kişinin yüzüne karşı bildirildiği andan itibaren kanunda yer verilen 15 günlük itiraz süresi başlamış demektir.

İtiraz Sebebi
İdari para cezalarına itiraz ederken dilekçe içeriğinde itiraz sebeplerini açıkça yazmak ve bunları delillendirmek gerekmektedir. Dolayısıyla Covid-19 sebebiyle alınan sokağa çıkma yasağına uyulmadığı için kesilen cezalara yapılan itirazlarda bu hususların dikkate alınması cezanın iptal edilebilmesi açısından önem arz etmektedir.
Kesilen cezalara itiraz edilirken o anda sokakta olmanın haklı bir mazereti olduğunu beyan edip bu beyanın da bir delille (bir hastane çağrı kâğıdı, hastane randevu belgesi vb.) desteklenmesi durumunda cezanın iptal edilme ihtimali daha yüksek olacaktır. Ayrıca yine kesilen cezaya itiraz ederken bahse konu sokağa çıkma yasağının hukuki olmadığı veya bu kararın kanunlarda öngörülen şekillerde alınmadığına ilişkin beyanlarda da bulunulabilecektir.
Covid-19 nedeniyle ülkemizde uygulanan sokağa çıkma yasakları 1 Haziran 2020 itibariyle sona erdi. Ancak kabahatler kanunu veya diğer kanunlara aykırı davranış sebebiyle kesilen idari para cezaları hayatımızda yer etmeye devam edecek. Bu nedenle yazımızda yer verdiğimiz itiraz süreçleri ve itiraz sebeplerine ilişkin açıklamaların diğer idari para cezaları için de geçerli olduğu unutulmamalıdır.
